OfferUpBid – Terms and Conditions

Last updated: 14 September 2026

These Terms and Conditions govern the use of the OfferUpBid website and auction platform by sellers, buyers and other registered users.

OfferUpBid is operated by:

OFFERUPBID LIMITED
Company number: 16247418
Registered in England & Wales
Trading as: OfferUpBid

These Terms apply to:

offerupbid-now.co.uk
auction.offerupbid-now.co.uk

By registering an account, submitting a vehicle, placing a bid, accepting an auction result, purchasing a vehicle or otherwise using OfferUpBid, you agree to these Terms where they apply to you.

Please read them carefully before using the platform.

1. About OfferUpBid

OfferUpBid is a UK online vehicle auction marketplace connecting vehicle sellers with approved buyers.

OfferUpBid provides a platform through which:

  • sellers can submit vehicles;

  • suitable vehicles can be presented to approved buyers;

  • approved buyers can review vehicle information and place bids;

  • vehicles can be offered through online auctions;

  • auction results can be presented to sellers;

  • sellers and successful buyers can be introduced to complete the transaction.

OfferUpBid normally acts as the marketplace and facilitator.

Unless expressly stated otherwise, OfferUpBid is not:

  • the seller of the vehicle;

  • the buyer of the vehicle;

  • the owner of the vehicle;

  • the registered keeper of the vehicle;

  • the person taking possession of the vehicle;

  • the provider of a vehicle warranty;

  • the person paying the seller the vehicle purchase price;

  • an Authorised Treatment Facility;

  • a scrapyard, breaker or dismantler.

OfferUpBid does not issue Certificates of Destruction.

The vehicle transaction is normally completed directly between the seller and successful buyer.

2. Eligibility to Use OfferUpBid

Users must be at least 18 years old.

Users must provide information that is true, accurate, complete and current.

You must not:

  • impersonate another person;

  • register using false information;

  • provide false identity or address documents;

  • use another person's account without permission;

  • create accounts for fraudulent purposes;

  • use OfferUpBid for unlawful activity;

  • attempt to avoid account restrictions by creating additional accounts.

OfferUpBid may request information or documents reasonably necessary to verify a user, vehicle or transaction.

3. Buyer Types

OfferUpBid may approve different types of buyers.

Private Individual

An individual purchasing a vehicle for personal use.

The auction platform may identify this account type as Individual.

Sole Trader

A self-employed person purchasing vehicles in connection with their business.

The auction platform may identify this account type as Solo Trader.

Motor Trader or Company

A motor trader, limited company or other business purchasing vehicles for business purposes.

The auction platform may identify this account type as Trader.

Users must select the buyer type that accurately describes their status.

A business or trader must not deliberately register as a private individual to avoid obligations that apply to business sellers or buyers.

4. Buyer Registration

Buyer registration is currently free.

There is currently no registration fee to apply for an OfferUpBid buyer account.

Registration does not guarantee approval.

Every buyer registration is manually reviewed by the OfferUpBid team before bidding access is enabled.

Approval normally takes between 1 and 5 working days, depending on the information and verification documents supplied.

OfferUpBid may:

  • contact an applicant by telephone;

  • contact an applicant by email;

  • request further information;

  • request further verification;

  • approve an account;

  • decline an application;

  • restrict access where appropriate.

Only approved buyer accounts can bid on vehicles.

5. Buyer Identity and Address Verification

Buyer applicants are required to provide verification information requested by OfferUpBid.

This normally includes the following.

Proof of Identity

You must provide ONE valid photo identification document, such as:

  • a valid driving licence; or

  • a valid passport.

Proof of Address

You must provide ONE recent proof-of-address document, such as:

  • utility bill;

  • council tax bill;

  • bank statement;

  • official government correspondence; or

  • another suitable document accepted by OfferUpBid.

Companies, motor traders and other business buyers may also be required to provide company or trading information.

Submitting verification documents does not guarantee approval.

OfferUpBid may request additional information where reasonably necessary for verification, security or fraud prevention.

Verification documents are processed in accordance with the OfferUpBid Privacy Policy.

6. Buyer Approval Is Not a Guarantee

OfferUpBid's verification and approval process is intended to improve platform security.

Approval of an account does not amount to a guarantee by OfferUpBid of a buyer's:

  • conduct;

  • financial position;

  • creditworthiness;

  • reliability;

  • ability to complete a transaction;

  • future behaviour.

Sellers should continue to take appropriate care when completing transactions.

7. Seller Eligibility

A seller may include:

  • a private vehicle owner;

  • sole trader;

  • motor trader;

  • business;

  • fleet operator;

  • company;

  • another person legally authorised to sell the vehicle.

A seller must have the legal right or proper authority to sell the vehicle.

A seller must not submit a vehicle that:

  • is stolen;

  • they have no authority to sell;

  • is subject to restrictions preventing lawful sale;

  • contains deliberately false ownership information.

Where outstanding finance exists, the seller must disclose it and ensure appropriate settlement arrangements can be completed before or as part of the sale.

OfferUpBid may request evidence that the seller owns or has authority to sell the vehicle.

8. Vehicles Accepted

OfferUpBid may consider vehicles in different conditions, including:

  • everyday used vehicles;

  • damaged vehicles;

  • faulty vehicles;

  • non-running vehicles;

  • MOT failures;

  • high-mileage vehicles;

  • ex-fleet vehicles;

  • Category N vehicles;

  • repairable Category S vehicles.

Category A and Category B vehicles are not accepted.

OfferUpBid may refuse any vehicle that it considers unsuitable for the platform.

Vehicles requiring processing through an Authorised Treatment Facility must be handled by an appropriately authorised facility.

9. Seller Vehicle Information

The seller is responsible for providing accurate and honest information about the vehicle.

Information may include:

  • registration number;

  • make;

  • model;

  • year;

  • mileage;

  • colour;

  • engine information;

  • MOT status;

  • service history where known;

  • mechanical faults;

  • engine faults;

  • gearbox faults;

  • electrical faults;

  • dashboard warning lights;

  • accident damage;

  • structural damage;

  • previous repairs;

  • insurance category;

  • whether the vehicle starts;

  • whether the vehicle drives;

  • missing parts;

  • keys available;

  • documentation available;

  • outstanding finance;

  • modifications;

  • vehicle location;

  • other significant information affecting the vehicle.

The seller must disclose material information known to them.

A seller must not deliberately hide, omit or misrepresent a known material fault or vehicle-history issue.

10. Vehicle Photographs

Vehicle photographs should be recent and reasonably represent the vehicle's current condition.

Known damage should not deliberately be hidden.

If the vehicle's condition materially changes after it has been submitted, the seller must notify OfferUpBid.

11. Use of Listing Content

By submitting vehicle information, photographs or other listing content, the seller confirms that they are entitled to provide that content.

The seller grants OfferUpBid a non-exclusive, royalty-free licence to host, reproduce, resize, format and display submitted content where reasonably necessary to:

  • operate the vehicle listing;

  • present the vehicle to buyers;

  • operate the auction;

  • communicate information about the vehicle;

  • administer the transaction;

  • operate and promote the OfferUpBid marketplace.

The seller does not transfer ownership of their original photographs to OfferUpBid merely by uploading them.

12. Review of Vehicle Submissions

OfferUpBid may review vehicle information before presenting the vehicle to buyers.

OfferUpBid may:

  • request more information;

  • request additional photographs;

  • correct obvious formatting errors;

  • reject unsuitable submissions;

  • remove listings that breach these Terms;

  • pause a listing where further verification is required.

OfferUpBid does not normally carry out a full physical or mechanical inspection of every vehicle before auction.

Reviewing a submission does not guarantee that all information supplied by the seller is accurate.

13. Standard 3-Day Auction

A standard OfferUpBid vehicle auction runs for 3 days.

During the auction period, approved buyers may review the available vehicle information and submit bids.

Bid levels may depend on factors including:

  • vehicle make and model;

  • age;

  • mileage;

  • condition;

  • location;

  • faults;

  • accident damage;

  • repair costs;

  • buyer demand;

  • market conditions.

OfferUpBid does not guarantee:

  • that a vehicle will receive bids;

  • a particular number of bids;

  • a minimum price;

  • a particular final price;

  • that every auction will result in a completed transaction.

14. Seller Must Keep the Vehicle Available During the Auction

Once a vehicle has been accepted into an active OfferUpBid 3-day auction, the seller must keep the vehicle available until the auction has ended.

During the active auction period, the seller must not sell, transfer or otherwise dispose of the vehicle elsewhere where doing so would prevent the OfferUpBid auction transaction from proceeding.

The vehicle remains the seller's property throughout the auction.

OfferUpBid does not own the vehicle.

If during the auction the vehicle:

  • becomes unavailable;

  • is damaged;

  • develops another significant fault;

  • is stolen;

  • is sold unexpectedly;

  • has important parts removed;

  • materially changes condition;

the seller must notify OfferUpBid as soon as possible.

15. Buyer Bids

A bid represents the amount that the buyer is prepared to offer for the vehicle based on the information available at that time.

Buyers must bid responsibly.

A buyer must not:

  • bid without a genuine intention to purchase;

  • artificially manipulate an auction;

  • use another account to inflate bidding;

  • submit sham bids;

  • collude with another buyer or seller to manipulate an auction;

  • interfere with the proper operation of bidding.

OfferUpBid may remove suspicious bids or restrict accounts where there are reasonable grounds to suspect manipulation, fraud or misuse.

16. Auction Result

When the auction closes, the highest valid bid becomes the auction result.

OfferUpBid will present or communicate the auction result to the seller.

The highest bid does not mean OfferUpBid itself has purchased the vehicle.

The seller reviews the auction result in accordance with the applicable OfferUpBid process.

17. Seller Acceptance and Confirmed Purchase

Where the seller accepts the auction result and the purchase becomes confirmed under the OfferUpBid process, the successful buyer and seller are expected to proceed with the transaction.

At this stage:

  • the seller agrees to proceed with the successful buyer;

  • the successful buyer agrees to proceed with the purchase;

  • the fixed £70 OfferUpBid buyer fee becomes payable by the successful buyer.

The vehicle transaction remains between the seller and buyer.

OfferUpBid facilitates the marketplace and introduction.

18. Buy Now

Where a Buy Now option is available, the listing or on-screen information may explain when the purchase becomes confirmed.

A buyer using Buy Now agrees to comply with these Terms and any specific information displayed for that listing.

Where a Buy Now purchase becomes confirmed, the £70 OfferUpBid buyer fee applies unless OfferUpBid expressly states otherwise before the purchase is made.

19. Seller Responsibilities After Acceptance

After accepting an auction result, the seller must:

  • keep the vehicle available for the successful buyer;

  • not deliberately damage or alter the vehicle;

  • not remove agreed parts or accessories;

  • disclose any material change in condition;

  • communicate reasonably with the buyer;

  • provide accurate collection information;

  • complete the transaction in good faith.

The seller must not substitute another vehicle or materially change the vehicle after accepting the auction result.

20. Buyer Due Diligence

Buyers are responsible for carrying out appropriate checks before completing a vehicle purchase.

Depending on the vehicle and transaction, buyers should consider:

  • a full HPI or equivalent vehicle-history check;

  • outstanding-finance checks;

  • stolen-vehicle checks;

  • insurance write-off history;

  • mileage history;

  • MOT history;

  • vehicle registration;

  • VIN or chassis-number verification;

  • V5C information;

  • seller authority to sell;

  • vehicle description;

  • photographs;

  • mechanical condition;

  • electrical condition;

  • disclosed faults;

  • accident damage;

  • an inspection where appropriate.

A V5C identifies the registered keeper but is not proof of ownership.

Buyers should carry out separate checks to satisfy themselves that the seller is entitled to sell the vehicle.

These responsibilities do not remove any legal duties applying to a seller.

21. Vehicle Inspection

A buyer may inspect or arrange an inspection of the vehicle where agreed with the seller.

Buyers should raise questions before completing the transaction where information appears unclear.

A buyer should not attempt to reduce an agreed purchase price merely because of a fault that was clearly and accurately disclosed before bidding.

Where a significant difference is found between the listing and the vehicle, the buyer should raise the matter promptly with the seller and, where appropriate, OfferUpBid.

22. Material Misdescription

Where the vehicle is materially different from the information supplied by the seller, the buyer and seller should attempt to resolve the issue before completing the transaction.

Examples may include:

  • significant undisclosed accident damage;

  • significant undisclosed mechanical failure;

  • incorrect vehicle identity;

  • material mileage discrepancy;

  • known insurance category not disclosed;

  • major components described as present but missing;

  • materially incorrect information about whether the vehicle starts or drives.

OfferUpBid may review information held on the platform when deciding whether account action is appropriate.

OfferUpBid does not guarantee that every dispute can be resolved by the platform.

23. Vehicle Purchase Payment

The successful buyer normally pays the agreed vehicle purchase price directly to the seller.

The £70 OfferUpBid buyer fee is separate from the vehicle purchase price.

OfferUpBid does not normally receive, hold or transfer the seller's vehicle purchase price.

The seller should independently confirm that the full agreed vehicle payment is genuinely cleared and available in their own bank account before releasing:

  • the vehicle;

  • keys;

  • documents;

  • possession of the vehicle.

Sellers should not rely solely on:

  • screenshots;

  • emails claiming payment has been made;

  • text messages;

  • banking-app images shown by another person;

  • pending bank transfers;

  • promises of payment.

If cleared funds cannot be independently confirmed, the seller should not release the vehicle.

24. OfferUpBid Buyer Fee

Buyer registration is currently free.

Selling through the standard OfferUpBid seller process is free for sellers.

There is:

  • no seller listing fee;

  • no seller commission;

  • no seller final-value fee.

A successful buyer must pay a fixed £70 OfferUpBid buyer fee for each confirmed vehicle purchase.

The £70 buyer fee is:

  • payable by the successful buyer;

  • separate from the vehicle purchase price;

  • not deducted from the seller's agreed vehicle price;

  • not payable by the seller.

The vehicle purchase price is normally paid directly to the seller.

The £70 buyer fee is paid separately to OfferUpBid.

25. When the £70 Buyer Fee Becomes Due

The £70 OfferUpBid buyer fee becomes due when:

  1. the seller accepts the auction result; and

  2. the vehicle purchase becomes confirmed under the OfferUpBid process and these Terms.

The successful buyer must pay the £70 buyer fee within 3 days of the confirmed purchase.

The buyer is responsible for ensuring that the fee is paid within the required period.

26. Failure to Pay the £70 Buyer Fee

If the £70 OfferUpBid buyer fee remains unpaid after the required 3-day period, OfferUpBid may take reasonable action under these Terms.

This may include:

  • restricting bidding access;

  • temporarily suspending the buyer account;

  • preventing participation in further auctions;

  • withholding approval for additional purchases;

  • contacting the buyer regarding the unpaid £70 fee;

  • requiring the outstanding fee to be paid before account access is restored;

  • permanently closing an account for repeated or serious non-payment;

  • taking reasonable steps to recover sums properly due.

OfferUpBid will not impose undisclosed penalties, interest or additional late-payment charges unless they are expressly provided for, legally permitted and properly disclosed.

27. One Buyer Fee Per Confirmed Vehicle Purchase

The £70 buyer fee applies to each vehicle purchase that becomes confirmed under the OfferUpBid process.

For example, if a buyer completes confirmed purchases of two separate vehicles, a separate £70 buyer fee applies to each confirmed vehicle purchase.

The buyer fee is not a registration fee or subscription fee.

28. Failure by a Buyer to Complete a Confirmed Purchase

Buyers should only bid on vehicles they genuinely intend to purchase.

Where a purchase has become confirmed, failure by the buyer to proceed without a legitimate reason may result in:

  • account restriction;

  • temporary suspension;

  • loss of bidding privileges;

  • refusal of further bidding access;

  • permanent closure for repeated or serious breaches.

Where non-completion results from a material seller misdescription, lack of authority to sell, vehicle unavailability or another significant seller-side issue, OfferUpBid may review the circumstances before deciding whether account action or the buyer fee remains appropriate.

Nothing in this section removes legal rights that cannot lawfully be excluded.

29. Seller Failure to Complete

Where a seller accepts an auction result and then refuses to proceed without a legitimate reason, OfferUpBid may:

  • investigate the circumstances;

  • restrict future submissions;

  • suspend access;

  • decline future vehicle listings;

  • take other reasonable action under these Terms.

This does not prevent a seller from raising a genuine issue involving fraud, buyer conduct, payment security or another legitimate concern.

30. Vehicle Collection

Vehicle collection is normally arranged directly between the successful buyer and seller.

Collection should take place after cleared payment of the agreed vehicle price has been confirmed by the seller.

The buyer is responsible for arranging suitable transport or recovery where required.

This is particularly important for:

  • non-running vehicles;

  • damaged vehicles;

  • MOT-failure vehicles;

  • mechanically faulty vehicles;

  • vehicles that cannot safely or lawfully be driven.

OfferUpBid does not guarantee free collection or same-day collection unless expressly stated for a particular transaction.

31. Damage During Collection or Transport

Where collection or transport is arranged directly by the buyer, seller or an independent transporter, responsibility for the conduct of that transport arrangement normally rests with the parties arranging or carrying it out.

Subject to applicable law, OfferUpBid is not responsible for damage caused solely by a buyer, seller, transporter or other independent third party where OfferUpBid did not cause that damage.

Nothing in this section excludes liability that cannot legally be excluded.

32. DVLA Notification

Following completion of a vehicle sale, the registered keeper is responsible for completing the appropriate DVLA notification.

The seller should ensure the transfer or disposal notification is completed correctly.

OfferUpBid does not become the registered keeper because the vehicle was auctioned through its platform.

33. Vehicle Condition

OfferUpBid auctions may include used vehicles with:

  • normal wear and tear;

  • high mileage;

  • mechanical faults;

  • electrical faults;

  • warning lights;

  • MOT failures;

  • accident damage;

  • previous repairs;

  • Category N history;

  • repairable Category S history;

  • non-running condition;

  • missing or damaged parts where disclosed.

Buyers should consider the disclosed condition before bidding.

34. Sold as Seen or as Described

Where legally permitted, a vehicle may be sold in its disclosed condition, sometimes referred to as sold as seen or sold as described.

A buyer is expected to consider all disclosed faults and condition information before bidding.

However, the words “sold as seen” do not remove any statutory or other legal rights that cannot lawfully be excluded.

35. Vehicle Warranties

OfferUpBid does not provide a mechanical warranty for vehicles sold through the marketplace unless OfferUpBid expressly states otherwise.

OfferUpBid does not guarantee:

  • future vehicle reliability;

  • repair costs;

  • engine life;

  • gearbox life;

  • electrical condition;

  • future MOT results;

  • future roadworthiness;

  • future resale value.

A seller may have separate legal responsibilities depending on their status and the circumstances of the transaction.

36. Consumer and Statutory Rights

Nothing in these Terms removes legal rights that cannot lawfully be excluded.

The legal rights applying to a vehicle transaction may depend on whether:

  • the seller is a private individual;

  • the seller is acting as a trader or business;

  • the buyer is a consumer;

  • the buyer is acting for business purposes;

  • other consumer-protection legislation applies.

Where a trader or business sells a vehicle to a consumer, applicable statutory consumer rights remain unaffected.

A trader must not falsely represent themselves as a private seller to avoid legal obligations.

OfferUpBid does not become the vehicle seller merely because the transaction was arranged through the OfferUpBid platform.

37. No Separate OfferUpBid Change-of-Mind Guarantee

OfferUpBid does not provide its own general change-of-mind vehicle return guarantee.

This does not prevent a buyer from exercising statutory rights against a seller where those rights legally apply.

A buyer should not assume they can return a vehicle merely because:

  • they later change their mind;

  • repairs are more expensive than expected;

  • the vehicle's resale value is lower than expected;

  • a clearly disclosed fault requires repair.

This section remains subject to applicable law.

38. Disputes Between Buyers and Sellers

The vehicle sale is normally between the successful buyer and seller.

Where a dispute concerns:

  • vehicle condition;

  • ownership;

  • payment;

  • collection;

  • disclosed faults;

  • alleged misdescription;

  • missing parts;

  • transaction arrangements;

the buyer and seller should first attempt to resolve the matter directly where appropriate.

OfferUpBid may:

  • review information held on the platform;

  • review auction records;

  • review communications provided to it;

  • investigate suspected misuse;

  • restrict accounts;

  • suspend accounts;

  • assist with communication where appropriate.

OfferUpBid is not required to act as a court, arbitrator, mechanic or independent vehicle inspector.

Users remain entitled to exercise any legal rights available to them.

39. OfferUpBid's Marketplace Role

OfferUpBid provides the online auction marketplace and facilitates introductions between users.

OfferUpBid does not guarantee:

  • that every user will complete a transaction;

  • that every vehicle description provided by a seller is accurate;

  • that every vehicle will receive bids;

  • a particular auction price;

  • payment by another user;

  • collection by another user;

  • the mechanical condition of a vehicle;

  • future vehicle reliability;

  • that buyer checks will discover every possible issue.

Buyer verification and account approval do not constitute a guarantee of another user's future conduct.

40. Matters Outside OfferUpBid's Reasonable Control

Subject to applicable law, OfferUpBid is not responsible for losses, disputes or damage caused solely by matters outside OfferUpBid's reasonable control and not caused by OfferUpBid's own breach or negligence.

Examples may include:

  • false information supplied by a user;

  • deliberately undisclosed vehicle faults;

  • fraudulent payment evidence supplied by another user;

  • a buyer or seller failing to complete;

  • collection damage caused by another party;

  • transport delays;

  • external banking delays;

  • disagreements between buyer and seller;

  • incorrect third-party vehicle-history information;

  • internet or telecommunications failures outside OfferUpBid's reasonable control.

41. Liability That Cannot Be Excluded

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

This includes liability that cannot lawfully be excluded for matters such as:

  • death or personal injury caused by negligence;

  • fraud;

  • fraudulent misrepresentation;

  • statutory rights that cannot lawfully be excluded;

  • other liabilities which applicable law does not permit OfferUpBid to exclude.

42. Fraud Prevention

OfferUpBid may take reasonable steps to prevent and investigate fraud.

These may include:

  • identity verification;

  • proof-of-address verification;

  • account review;

  • vehicle-information checks;

  • reviewing suspicious bidding;

  • reviewing suspicious transactions;

  • requesting additional information;

  • restricting accounts;

  • suspending accounts;

  • preserving relevant records;

  • reporting suspected criminal activity to appropriate authorities where necessary.

Users must not deliberately obstruct legitimate fraud or security investigations.

43. Account Security

Users are responsible for keeping their account credentials secure.

Do not share:

  • passwords;

  • one-time security codes;

  • complete banking credentials;

  • complete payment-card information through ordinary platform messages.

Users should be alert to:

  • fake OfferUpBid communications;

  • false payment confirmations;

  • overpayment scams;

  • requests to refund alleged overpayments;

  • suspicious changes to bank details;

  • pressure to release a vehicle before payment clears.

Users should promptly report suspected unauthorised account access or suspicious activity.

44. Prohibited Conduct

Users must not:

  • commit fraud;

  • submit false information;

  • submit false verification documents;

  • manipulate auctions;

  • engage in shill bidding;

  • create accounts to avoid restrictions;

  • deliberately avoid properly due OfferUpBid buyer fees;

  • threaten or abuse users or OfferUpBid staff;

  • upload malicious software;

  • interfere with platform security;

  • unlawfully scrape or misuse platform data;

  • infringe another person's intellectual-property rights;

  • use OfferUpBid for unlawful purposes.

OfferUpBid may investigate suspected breaches.

45. Account Restriction, Suspension and Closure

OfferUpBid may reasonably restrict, suspend or close an account for reasons including:

  • suspected fraud;

  • security concerns;

  • false registration information;

  • false identity documents;

  • false proof-of-address documents;

  • unpaid £70 buyer fees;

  • abusive conduct;

  • auction manipulation;

  • repeated failure to complete confirmed purchases;

  • deliberate vehicle misdescription;

  • misuse of the platform;

  • serious or repeated breach of these Terms.

OfferUpBid may request additional information before restoring access.

Previous approval does not guarantee permanent access to the auction platform.

46. Website and Auction Availability

OfferUpBid aims to keep its website and auction platform available but uninterrupted operation cannot be guaranteed.

The platform may occasionally be unavailable because of:

  • maintenance;

  • updates;

  • security issues;

  • technical faults;

  • hosting issues;

  • events outside OfferUpBid's reasonable control.

Where reasonably practicable, OfferUpBid may take steps to address auctions materially affected by platform problems.

47. Intellectual Property

The OfferUpBid name, logo, website content, platform design, software and other intellectual property belonging to OfferUpBid or its licensors may not be copied, reproduced, distributed or commercially exploited without permission except where permitted by law.

Rights relating to seller-uploaded vehicle content are dealt with separately in these Terms.

48. Privacy and Personal Information

Personal information is processed in accordance with the OfferUpBid Privacy Policy.

This may include information relating to:

  • sellers;

  • buyers;

  • buyer registrations;

  • identity documents;

  • proof of address;

  • vehicle submissions;

  • bids;

  • auction results;

  • transactions;

  • buyer fees;

  • fraud prevention;

  • account security.

Users should read the Privacy Policy before registering or using the platform.

49. Legal and Regulatory Reporting

OfferUpBid may collect, verify, retain or disclose user and transaction information where required by:

  • applicable tax laws;

  • accounting obligations;

  • digital-platform reporting requirements;

  • court orders;

  • law-enforcement requirements;

  • regulatory requirements;

  • other applicable legal obligations.

Nothing in these Terms prevents OfferUpBid from complying with a lawful reporting or disclosure requirement.

50. Taxes and Other User Obligations

Buyers and sellers remain responsible for their own tax, accounting, insurance and other legal obligations arising from buying or selling vehicles.

OfferUpBid does not provide individual tax, accounting or legal advice.

The £70 OfferUpBid buyer fee is separate from:

  • the vehicle purchase price;

  • transport or recovery costs;

  • repairs;

  • insurance;

  • taxes or other obligations applying to the buyer.

51. Complaints

Users with a complaint about OfferUpBid should use the OfferUpBid Complaints Procedure or the current contact channels published on the OfferUpBid websites.

Where a complaint relates primarily to a vehicle transaction between a buyer and seller, those parties should first attempt to resolve the issue directly where appropriate.

OfferUpBid may investigate conduct occurring through the platform.

52. Changes to These Terms

OfferUpBid may update these Terms where reasonably necessary because of:

  • changes to the platform;

  • changes to services;

  • operational changes;

  • security requirements;

  • legal or regulatory requirements.

The latest version will display its current update date.

Where appropriate, OfferUpBid may notify registered users of material changes.

Changes will not be used unfairly to rewrite the contractual terms of an already confirmed transaction retrospectively.

53. Severability

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply so far as legally possible.

54. No Waiver

If OfferUpBid does not immediately enforce a provision of these Terms, this does not necessarily mean OfferUpBid has waived its right to enforce that provision later.

55. Account Transfers

Accounts are personal to the registered individual or business.

Users must not sell, transfer or give another person control of an OfferUpBid account without permission.

OfferUpBid may transfer its own rights or obligations to a successor business where legally permitted and where doing so does not unfairly reduce user rights.

56. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you retain any mandatory rights and protections available to you under applicable law.

Nothing in these Terms is intended to prevent a consumer from exercising any court or other legal remedy available under applicable law.
